SOFTWARE LICENSE AGREEMENT
LICENSE:
This Yachts 3D Screensaver End-User License Agreement ("EULA") is a legal agreement between you and Best-of-Computing.
Yachts 3D Screensaver is Freeware
You may make copies of the SOFTWARE as you wish; give exact copies of the original SOFTWARE to anyone; and distribute the SOFTWARE in its unmodified form via electronic means (Internet, BBS`s, Shareware distribution libraries, CD-ROMs, etc.). You may not charge any fee for the copy or use of the SOFTWARE itself, but you may charge a distribution fee that is reasonably related to any cost you incur distributing the SOFTWARE (e.g. packaging). You must distribute a copy of this EULA with any copy of the SOFTWARE and anyone to whom you distribute the SOFTWARE is subject to this EULA.
RESTRICTIONS: You may not reverse engineer, de-compile, or disassemble the SOFTWARE.
NO WARRANTIES: BEST-OF-COMPUTING EXPRESSLY DISCLAIMS ANY WARRANTY for the SOFTWARE. The SOFTWARE and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE remains with you.
THIS SOFTWARE IS NOT FAULT TOLERANT AND SHOULD NOT BE USED IN ANY ENVIRONMENT WHICH REQUIRES THIS.
LIMITATION OF LIABILITY: NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT, YOU AGREE THAT BEST-OF-COMPUTING SHALL NOT BE LIABLE, UNDER ANY LEGAL PRINCIPLE, FOR ANY DAMAGES INCURRED BY YOU (INCLUDING BUT NOT LIMITED TO DIRECT OR INDIRECT DAMAGES FOR LOSS OF DATA, BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR OTHER COMMERCIAL OR PECUNIARY LOSS, ANY CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGE) OR ANY OTHER PERSON OR ENTITY AS A RESULT OF YOUR USE OF INABILITY TO USE THE SOFTWARE OR DOCUMENTATION EVEN IF BEST-OF-COMPUTING HAS BEEN ADVISED OF THE P0SSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
