CST Trend ActiveX Control

CENTURY SOAR TECHNOLOGY CO., LTD. LICENSE AGREEMENT
This is a license, not a sales agreement, between you, the end user and Century Soar Technology Co., Ltd. (It will be referred to henceforth as `CST`). By installing CST`s product on your computer, you are agreeing to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, promptly return the unopened package, together with all the other material which comprises the product, respectively delete all CST`s product related files.
1. LICENSE GRANT
This license is for a single developer and not for an entire company. If additional programmers wish to use CST`s product, additional copies must be licensed.
You may:
a. install the software on only one computer.
b. make one copy of the software in machine readable form solely for backup purposes, provided that you reproduce all proprietary notices on the copy.
c. transfer the software from one computer to another provided that the software is used on only one computer at a time.
d. distribute copies of the *.ocx, *.bpl with your products royalty-free under section 3.
You may not:
a. distribute the license file(*.lic) under any circumstances.
b. use the software on more than one computer, workstation, or file server at a time in a network or multi-user system.
c. reverse engineer, decompile, disassemble, create derivative works based on, or copy (except for the backup copy) the software or the accompanying documentation.
d. modify or remove any proprietary notices on the software and documentation.
e. rent or lease any rights for the software or documentation in any form to anyone.
2. CONFIDENTIALITY
The Licensee is provided with the product information that is needed to install or unlock the software, it includes the serial number or the registration code. Transfering the product information will be considered as illegally copying the software. You are not allowed to use such a code in a way that makes these information visible to anyone which is not entitled to use it.
3. ROYALTIES
CST grants the Licensee a nonexclusive, royalty-free right to redistribute the copy of the CST`s files which only includes *.ocx and *.bpl. This is true in all cases unless your application`s distribution necessitates the distribution of CST licensing for CST`s product(s). This would be the case if:
1. You are creating a container*.
2. You are aggregating the CST`s component(s) and are distributing the aggregated component(s).
3. You are creating a new component based CST`s components.
Note*: A container is a design environment like Visual Basic which allows developers or end users to drop third-party components into it.
4. COPYRIGHT
All rights, title and copyrights in and to the software, the accompanying documentation, and any copies of the software are owned by CST. The software is protected by copyright laws and international treaty provisions. Unauthorized copying of the software or the documentation, or failure to comply with the above restrictions, will result in immediate and automatic termination of this license.
5. LIMITATIONS
No liabilities for consequential damages.
To the maximum extent permitted by applicable law, CST is not liable for any special, incidental, indirect, or consequential damages or losses which may result from the use or installation of CST product.
6. WARRANTY
THE SOFTWARE AND DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANT OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CST WARRANTS THAT THE SOFTWARE WILL PERFORM SUBSTANTIALLY IN ACCORDANCE WITH THE ACCOMPANYING WRITTEN MATERIALS FOR A PERIOD OF THIRTY(30) DAYS FROM THE DATE OF RECEIPT.
CST`S AND ITS SUPPLIERS` ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE, AT CST`S OPTION, EITHER (A) RETURN OF THE PAID PRICE, OR (B) REPAIR OR REPLACEMENT OF THE SOFTWARE. ANY REPLACEMENT SOFTWARE WILL BE WARRANTED FOR THE REMAINDER OF THE ORIGINAL THIRTY(30) DAY PERIOD.
This warranty shall not apply to any failure or deficiency which has been caused by misuse, neglect, alteration or modification, improper installation, or unauthorized repair.
7. TERMINATION
You may terminate this license at any time by destroying all copies of the software or by returning them to CST, but this does not entitle you to a refund. CST may terminate this license if you fail to comply with the terms and conditions of this license agreement. Upon such termination, you must destroy and/or return all your copies of the software. You agree to be responsible for the payment of any taxes resulting from this agreement.
