BY INSTALLING, DOWNLOADING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. GLIMMER GAMES grants you the right to use Kick Shot Pool ("the software"). For purposes of this section, "use" means loading the game into RAM as well as installation on a hard disk or other storage device.
You may use the trial version of the software for an unlimited amount of time. However, it is suggested that you obtain the full version if you use the software beyond a period of 30 days.
You may freely distribute, transmit and store the trial version of the software on any electronic media, including but not limited to floppy diskette, hard disk, CD-ROM or other storage device, provided that you do not remove, edit, modify, or otherwise alter the original files of the software.
You may not distribute the registered version of the software under any circumstances.
You may not modify, translate, disassemble, decompile, reverse engineer or create derivative works based upon the software.
This software is copyrighted by Glimmer Games and is protected by international copyright laws and international treaty provisions. You must treat the game like any other copyrighted material. You agree to use your best efforts to see that any user of the software licensed hereunder complies with this agreement.
This software and accompanying written materials (including instructions for use) are provided "as is" without warranty of any kind. Further, Glimmer Games does not warrant or make any guarantees representations regarding the use, or the results of use, of the software or written materials in terms of correctness, accuracy, reliability, currentness, or otherwise. The entire risk as to the results and performance of the software is assumed by you.
The above is the only warranty of any kind, either expressed or implied, including but not limited to, implied warranties of merchantability or fitness for a particular purpose. In any case, Glimmer Games shall not be liable for any direct, indirect, consequential or incidental damages (including damages for loss of business profits, business interruption, loss of business information and loss of data) arising out of the use or inability to use the software, even if Glimmer Games has been advised of the possibility of such damages.
