Software Licence Agreement for IceWarp eMail Server

EULA

Note: This is a legal agreement between You (our Customer) and us, Icewarp Ltd.
(Icewarp), which governs your use of the IceWarp Merak Mail Server or any of its
components selected by you on the Component License Sheet. By using
IceWarp Merak Mail Server, you agree to be bound by the terms and conditions
of this Software Licence Agreement. You are not allowed to use
IceWarp Merak Mail Server without agreeing to the terms and conditions hereof.

This Software Licence Agreement is for the full version of IceWarp Merak Mail Server and
provides you also a right to access without additional payment all released
updates/upgrades of the IceWarp Merak Mail Server for a period of one year. You can
prolong this period for additional year(s) against payment of annual maintenance fee.
Icewarp reserves the right to license, on the basis of a modified or entirely new licence
agreements, any future or other versions of IceWarp Merak Mail Server.

All rights reserved.

You may use this product only under a single operating system. For the avoidance
of doubt, you need a separate EULA per each and every operating system of each
and every CPU on which the IceWarp Merak Mail Server is installed.

You acquire no right to distribute the IceWarp Merak Mail Server and no right to copy the
product and/or any associated product documentation unless agreed with Icewarp Ltd.
in writing.

You agree not to decompile, disassemble or reverse engineer the IceWarp Merak Mail Server.

You acknowledge that you obtain no ownership rights to the IceWarp Merak Mail Server under
the terms of this Software License Agreement. All rights in the product including
but not limited to trade secrets, trademarks, service marks, patents and copyrights
are, shall be and will remain the property of Icewarp Limited or any third party
contributor from whom Icewarp has licensed software or technology.

You may not remove any proprietary noticek, labels, trademarks on the Merak Mail
Server product or documentation.

Upon installation, the program will send an informative email to our server.
The information contained in this email is strictly confidential and is used for no
other purpose than to aggregate installation statistics.






THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS
AND CONTRIBUTORS"AS IS" AND ANY EXPRESS OR IMPLIED
WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED
WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR
A PARTICULAR PURPOSE ARE DISCLAIMED. TO THE MAXIMUM
EXTENT PERMITTED BY APPLICABLE LAW SHALL THE
COPYRIGHT HOLDERS OR CONTRIBUTORS NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY,
OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT
LIMITED TO, LOSS OF USE, DATA, OR PROFITS; OR
BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON
ANY THEORY OF LIABILITY, WHETHER IN CONTRACT,
STRICT LIABILITY OR TORT (INCLUDING NEGLIGENCE
OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF
THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY
OF SUCH DAMAGE. IN NO EVENT SHALL THE TOTAL
LIABILITY OF THE COPYRIGHT HOLDERS OR CONTRIBUTORS
EXCEED THE PRICE YOU PAID FOR THE PRODUCT LICENSED
HEREUNDER.

Software Licence Agreement for the Evaluation Version of IceWarp Merak Mail Server

For Evaluation and Testing Purposes Only

Note: This is a legal agreement between You (our Customer) and us, Icewarp Ltd.
(Icewarp), which governs your use of the Testing Version of IceWarp Merak Mail Server or
any of its components selected by you on the Component License Sheet. By using
IceWapr Merak Mail Server, you agree to be bound by the terms and conditions of this
Software Licence Agreement. You are not allowed to use IceWarp Merak Mail Server
without agreeing to the terms and conditions hereof.

This Software Licence Agreement is for the Testing Version of IceWarp Merak Mail Server
and provides limited rights for testing purposes only. Icewarp reserves the right to
license, on the basis of a modified or entirely new licence agreements, any future
or other versions of IceWarp Merak Mail Server.

Software Licence Agreement for the Freeware Version of IceWarp Merak Mail Server

Note: This is a legal agreement between You (our Customer) and us, Icewarp Ltd.
(Icewarp), which governs your use of the Freeware Version of IceWarp Merak Mail Server
or any of its components selected by you on the Component License Sheet. By using
IceWarp Merak Mail Server, you agree to be bound by the terms and conditions of this
Software Licence Agreement. You are not allowed to use IceWarp Merak Mail Server
without agreeing to the terms and conditions hereof.

This Software Licence Agreement is for the Freeware Version of IceWarp Merak Mail Server.
Freeware Version is provided free of charge but has a limited functionality
compared to the full EULA version of IceWarp Merak Mail Server. Icewarp reserves the
right to license, on the basis of a modified or entirely new licence agreements,
any future or other versions of IceWarp Merak Mail Server.
