LottoJet Lottery Software

1. By Installing LottoJet software you accept
the terms of this agreement.
2. LottoJet reserves the right to update the
terms of use at any time without notice to
you. The most current version of the terms of
use can be reviewed at the www.LottoJet.com
web site.
3. The LottoJet software is provided to you AS
IS.
4. LottoJet hereby disclaims all warranties
and conditions (whether statutory, express
or implied) with regard to the LottoJet
software, INCLUDING ALL WARRANTIES AND
CONDITIONS OF FITNESS FOR A PARTICULAR
PURPOSE, SUCCESS IN THE LOTTERY, TITLE
AND NON-INFRINGEMENT.
5. In no event will LottoJet be liable for any
damage (including, for example direct damage,
indirect damage or consequential damage)
resulting from or in connection with the
execution of, performance of and/or the use
of the LottoJet software and/or an inability
to use the LottoJet software.
6. When the LottoJet software is used to fill
in lottery forms you MUST check the
compliance of the filled in lottery forms
with the Lottery rules and/or regulation,
as well as make sure that the lottery forms
were actually filled in properly.
7. The intellectual Property (including
copyright, trade secrets, confidential
information and the like) that is embedded
within the LottoJet software is solely owned
by LottoJet.
8. Upon acceptance of this agreement LottoJet
grants you a non-exclusive, non-assignable
license to install the LottoJet software on a
single computer that is under your control.
9. Under said license you are not allowed to
sell, copy, reverse–engineer, modify,
sub-license, rent, lease and/or make a
derivative work from the LottoJet software.
10. LottoJet reserves the right to check your
compliance with these terms of use. Said
check may include applying various protective
measures. The execution of said protective
measures is also subjected to articles
4 and 5.
11. You allow LottoJet to apply various
protective measures, including measures that
search for identification information of your
computer and/or any installed software, as
well as components of said computer.
These details will be kept in secret.
12. LottoJet reserves the right to automatically
terminate this agreement, disable your
software (as well as it reserves the right
to initiate legal proceedings against you or
to be entitled to any remedy provided by law)
upon failure by you to comply with the terms
of use.
13. Upon notice of termination you agree to
destroy all copies of the LottoJet software
you have.
14. Beginning at the order date, you are entitled
for a 30 days timeframe for which you can
cancel your order and be fully refunded.
15. This Agreement shall be governed by Israeli
Law.
16. You consent to the jurisdiction and venue in
the courts sitting in Tel Aviv, Israel.
You waive all defenses of lack of personal
jurisdiction and forum nonconveniens.
17. This License is the entire agreement between
you and LottoJet, supersedes any other
agreement or discussions, oral or written and
may not be changed except by a written signed
agreement.
18. If any part of this Agreement is found void
and unenforceable, it will not affect the
validity of the balance of the Agreement,
which shall remain valid and enforceable
according to its terms.
