Paying the shareware fee allows you the right to use a single copy of the Software for an unlimited period of time with free upgrades of any future version. You may try the Software for free for up to a limited uses. The Software and its related documentation are provided "as is" and without warranty of any kind and ( MMIV The Kandalu Software ) expressly disclaims all other warranties, expressed or implied, including, but not limited to, the implied warranty of usability for a particular purpose (iPod manage music). Under no circumstances shall ( MMIV The Kandalu Software ) be liable for any incidental or consequential damages that result from the use or inability to use the Software or related documentation.
IN NO EVENT SHALL KANDALU SOFTWARE BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) ARISING IN ANY WAY OUT OF THE USE, REPRODUCTION, MODIFICATION AND/OR DISTRIBUTION OF THE SOFTWARE, HOWEVER CAUSED AND WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF KANDALU SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
