Simple RS 232 Monitor LICENSE AGREEMENT
CAREFULLY READ ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT PRIOR TO THE USE OF THE Simple RS 232 Monitor SOFTWARE PRODUCT. USE OF THE PRODUCT INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT,
PROMPTLY RETURN THE UNOPENED DISK PACKAGE AND THE ACCOMPANYING ITEMS. THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND MICRO-ACTIVE AUSTRALIA PTY LTD.

The Simple RS 232 Monitor programs and its related documentation are copyrighted and at all times remains the property of Micro-Active Australia Pty. Ltd.
LICENSE
This is a license agreement. This is not an agreement for a sale.
You are granted a non-exclusive, non-transferable right to use the enclosed programs. You may use the programs on a single computer (one central processing unit) which you own or use. Title to the software, related documentation and any copies thereof is retained by Micro-Active Australia Pty Ltd. You may make copies of the software solely for the purpose of backing up and protecting your investment.
LIMITED WARRANTY
Micro-Active Australia Pty Ltd warrants that the physical diskette(s) and the physical documentation provided herein are free of defects in material and workmanship, assuming normal use. In the event a defect occurs in material or workmanship, Micro-Active Australia Pty Ltd will replace the defective diskette or documentation. Micro-Active Australia Pty Ltd`s entire liability and your sole and exclusive remedy shall be the defective diskette or documentation.
MICRO-ACTIVE AUSTRALIA PTY LTD MAKES NO OTHER WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE Simple RS 232 Monitor SOFTWARE IS LICENSED ON AN "AS IS" BASIS. THE ENTIRE RISK AS TO QUALITY AND PERFORMANCE IS WITH YOU. IN NO EVENT WILL MICRO-ACTIVE AUSTRALIA PTY LTD BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO ANY LOSS OF BUSINESS, INTERRUPTION OF SERVICE, LOSS OF ANTICIPATORY PROFITS, OR YOUR INABILITY TO USE THE PRODUCT.
You are licensed to use this product, if and only if, the necessary licence fees have been paid in full to Micro-Active Australia Pty Ltd and the registration form is completed and returned to Micro-Active Australia Pty Ltd within 14 days of receipt of this notice. In the event you fail to fulfil these commitments, Micro-Active Australia Pty Ltd may exercise its right to unequivocally cancel the license.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable it shall be deemed severable from, and shall in no way affect the validity or enforceability of the remaining provisions of this agreement.
This agreement shall be governed by the laws of Queensland, Australia.
