Cartagio™ Software Distribution Agreement

Cartagio™ Lite, Cartagio™ Home, Cartagio™ Pro, Cartagio™ Enterprise and the Cartagio™ Enterprise Server software (the "Software") is owned by and remains the property of Missiontrek Ltd. Co., and is transferred to the Distributor ("Distributor") for distribution only according to the terms set forth below. Distribution of the software indicates your acceptance of these terms.

Except as expressly provided in this Agreement, you may not modify, reverse engineer, decompile, disassemble, distribute, sub-license, sell, rent, lease, give or in any way transfer, by any means or in any medium, including telecommunications, the Software.

You will use your best efforts and take all reasonable steps to protect the Software from unauthorized distribution, copying or dissemination, and will maintain all proprietary notices intact.

Disclaimer

This Software is provided for distribution "as is". All warranties and representations of any kind with regard to the Software are hereby disclaimed, including the implied warranties of merchantability and fitness for a particular purpose.

You assumes all risk for distribution of the software. Under no circumstances will the developer, manufacturer or seller of the Software be liable for any consequential, incidental, special or exemplary damages.

This Agreement gives you specified legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction. Some jurisdictions do not allow the exclusion or limitation of warranties, so the above limitations or exclusions may not apply to you.

Term

This Agreement is effective as of the time you distribute the Software, and shall continue in effect until you cease all distribution of the Software and return or destroy all copies thereof, or until automatically terminated upon your failure to comply with any of the terms of this Agreement.

General

This Agreement is the complete and exclusive statement of our agreement. Should any provision of this Agreement be held to be invalid by any court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remainder of the Agreement shall nonetheless remain in full force and effect. This Agreement shall be controlled by the laws of the State of Texas, USA.

Distribution

Provided that you verify that you are distributing the latest trial distribution version of Cartagio Lite, Cartagio Home, Cartagio Pro, Cartagio Enterprise and/or the Cartagio Enterprise Server, available at www.missiontrek.com/cartagio/download, from the Missiontrek Ltd. Co. website in its entirety, you are hereby licensed to make as many copies of Cartagio Lite, Cartagio Home, Cartagio Pro, Cartagio Enterprise and/or the Cartagio Enterprise Server as you wish; give exact copies of Cartagio Lite, Cartagio Home, Cartagio Pro, Cartagio Enterprise and/or the Cartagio Enterprise Server to anyone; and distribute Cartagio Lite, Cartagio Home, Cartagio Pro, Cartagio Enterprise and/or the Cartagio Enterprise Server in its unmodified form via electronic means. There shall be no charge for the right to distribute any of the above software titles.

You are specifically prohibited from charging, or requesting donations, for any such copies, however made; and from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission (for enquiries, email sales@missiontrek.com and ask about our affiliate program).

You agree to make a reasonable effort to include at least the following description in association with any download link to the software, depending on the version linked to:

Cartagio™ Lite, free reader for Project-Based Browsing (PBB) files, by Missiontrek™;

Cartagio™ Home, Project-Based Browsing software for educational and home use, by Missiontrek™;

Cartagio™ Pro, Project-Based Browsing software for business and professional use, by Missiontrek™;

Cartagio™ Enterprise, Project-Based Browsing software for multi-user, enterprise use, by Missiontrek™;

Cartagio™ Enterprise Server, Project-Based Browsing file server for enterprise use, by Missiontrek™.
