This Software Licensing Agreement ("Agreement") is a legal agreement between you and Nuclear Games, LLC ("Nuclear Games"). By installing this Software, by loading or running the Software, by placing or copying the Software onto your hard drive, or by distributing the Software, you agree to be bound by the terms of this Agreement. These are the only terms by which Nuclear Games permits copying or use.

General terms:

1. THE SOFTWARE.
The Software licensed under this agreement is the computer program MachineHell, which consists of executable files, data files, and documentation.

2. GRANT OF LICENSE.
The Software is distributed by Nuclear Games on a shareware basis. You are expected to use this program on your system and to thoroughly evaluate its usefulness and functionality before making a purchase. This "try before you buy" approach is the ultimate guarantee that the Software will perform to your satisfaction. Nuclear Games grants you the right to the use Software in accordance with the terms of this Agreement. You may not modify, translate, disassemble, reverse engineer, decompile, or create derivative works based upon the Software. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

3. DEMO (SHAREWARE) VERSION LICENSE.
You may distribute copies of the demo version of the Software freely to other users, provided that any copy must contain the original, unaltered files and proprietary notices. You have the ability to get full version of the Software at any time by purchasing it from Nuclear Games. Once you have obtained the full version, the Full Version License below will then apply.

4. FULL (REGISTERED) VERSION LICENSE.
When you purchase the Software, you will receive the full registered version. You agree not to distribute the full version to others and to use it only for your own personal use of the Software. You acknowledge that unauthorized distribution of the full version of the Software to others, whether intentional or unintentional, could damage Vendor both financially and professionally. Therefore, you agree that any unauthorized distribution of your registered copy of the Software to others will result in immediate and automatic termination of your license.

5. NO WARRANTY.
THE MACHINEHELL IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE IT AT YOUR OWN RISK. WE MAY NOT BE HELD LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.

6. TERM.
The term of this license grant is perpetual. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. Your license to use the Software will automatically terminate if you breach the terms of this Agreement.

7. DISTRIBUTION.
Nuclear games allows and encourages all web sites, on-line services, shareware disk vendors, CD-ROM vendors, and end-users to freely distribute the demo version of this Software. It is generally not necessary to contact Nuclear Games for authorization, and you may begin offering the demo version immediately.

8. COPYRIGHT.
The Software is exclusively owned by Nuclear Games and is protected by copyright laws and international treaties. You must treat the Software like any other copyrighted material, except that you may make copies of the demo version of the Software to give to other persons under the terms of this Agreement. You may not distribute copies of full version of the Software to other users. Except as expressly licensed by Nuclear Games, Nuclear Games reserves the exclusive copyright and all other rights, title and interest to distribute the Software, and to use Trademarks in connection with them. All rights not expressly granted here are reserved by Nuclear Games.
