Distribution permisions for
Alpha Omega Personal Information Manager
This Trial Software Distribution Agreement ("TSDA") is a legal agreement between you (either an individual or a single entity) and Omega Magnus Corp. for all Omega Magnus software products (magnusware.com), which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Product").
1. GRANT OF LICENSE.
Omega Magnus Corp. grants you the following rights provided that you comply with all terms and conditions of this TSDA:
a) Installation and use: You may install and use the Product according to the terms of the Omega Magnus Software TSDA included with the Product.
b) Reservation of Rights. Omega Magnus Corp. reserves all rights not expressly granted to you in this TSDA.
2. SCOPE OF DISTRIBUTION:
You may distribute the trial or "shareware" versions of the Product via Website, Magazine, Book, or CD with no further permission from Omega Magnus Corp. Any other methods of distribution must be approved in writing. You must not distribute Product under any other name or representation.
4. LIMITATION OF LIABILITY AND REMEDIES
Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of Omega Magnus Corp. and any of its suppliers under any provision of this TSDA and your exclusive remedy for all of the foregoing (except for any remedy of repair or replacement elected by Omega Magnus Corp. with respect to any breach of the Limited Warranty) shall be limited to the greater of the amount actually paid by you for the Product or U.S.$5.00. The foregoing limitations, exclusions and disclaimers (including Sections 11, 12 and 13 above) shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.
