FREE USE LICENSE

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS.

YOU AGREE THAT ALL OF THE TERMS AND CONDITIONS BELOW APPLY TO YOU AND ANYONE ELSE WHO USES THIS SOFTWARE, IF EITHER:

· YOU CLICK THE "ACCEPT" BUTTON, OR
· YOU COPY, INSTALL, OR USE THIS COPY OF ROMCENTER, OR
· YOU PERMIT OR ENABLE OTHERS TO COPY, INSTALL OR USE THIS COPY OF ROMCENTER

IF YOU DO NOT AGREE, PLEASE TERMINATE INSTALLATION IMMEDIATELY, AND DO NOT USE THIS SOFTWARE.

1. SOFTWARE COVERED BY THIS LICENSE

This license agreement ("Agreement") applies only to the version of RomCenter with which this Agreement is included.
Different license terms may apply to other versions of RomCenter.

2. FREE USE LICENSE.

(a) Original Distribution Package Necessary. In order to qualify for the free use license described below, you must have downloaded or received RomCenter in the form of an original distribution package as distributed by Eric Bole-Feysot, including all files contained in such package ("Original Distribution Package").
Current Original Distribution Packages for RomCenter are available from RomCenter home page (www.romcenter.com) and authorized distributors.
Copies of RomCenter not received in the form of an Original Distribution Package are not licensed for use, copying or transmission by you or others.

(b) You may, free of charge:
· install and use RomCenter free of charge, for the purpose of managing your own files.
· copy, store, distribute and transmit, free of charge, identical copies of this Original Distribution Package of RomCenter to others.

"Proper use" of RomCenter is use of the RomCenter program fully in accordance with guidelines.
If you have any questions as to proper use of this RomCenter program, you may contact support via the contact information included in this Original Distribution Package.

(c) You may not:
· permit others to use this RomCenter program unless they are properly licensed under this Agreement.
· modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on, this RomCenter program.
· sell or license copies of RomCenter to others.
· remove any proprietary notices or labels on RomCenter.

4. SUPPORT. RomCenter contains online help files and a discussion forum service is offered on the RomCenter home page (www.romcenter.com).
However, hard-copy documentation and telephone assistance are not available under this free license.

5. DISCLAIMER OF WARRANTY. THIS PROGRAM COMES WITH NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. IN NO EVENT WILL I BE LIABLE FOR ANY DAMAGES RESULTING FROM THE PROPER OR IMPROPER USE OF THIS SOFTWARE. YOU USE THIS PROGRAM AT YOUR OWN RISK.
THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.

6. ROM IMAGES. ROM, disks and cartridges ("ROMs") images are copyrighted material. Most of them cannot be distributed freely.
Distribution of RomCenter on the same physical medium as illegal copies of ROM images is strictly forbidden.
You are not allowed to distribute RomCenter in any form if you sell, advertise, or publicize illegal CD-ROMs or other media containing ROM images.
This restriction applies even if you don`t make money, directly or indirectly, from those activities.
You are allowed to make ROMs and RomCenter available for download on the same website, but only if you warn users about the ROMs`s copyright status, and make it clear that users must not download ROMs unless they are legally entitled to do so.

7. TERMINATION. The license will terminate automatically if you fail to comply with any of the limitations, conditions or obligations described herein.
On termination, you must destroy all copies of the RomCenter software and all other materials in this RomCenter Original Distribution Package.
