End Users License Agreement (EULA)

This software is subject to the following license terms and conditions. Use of this software constitutes acknowledgment of and acceptance of this agreement. This license is granted by Tagkeys, Inc. the author and owner, hereinafter referred to as the "Owner." This Software is licensed to you as the end user. IT IS NOT SOLD.

This software is copyrighted material. You agree that the Owner retains exclusive ownership of the software, and all of the documentation and computer recorded data related thereto. After you have paid any required license fee, you may use the software provided you do not violate the copyright and if you follow these simple rules.

A. You may make one (1) copy of the licensed software for backup purposes only and that copy, together with the original must be kept in your possession and control.

B. You may use the software on any computer for which it is designed so long as no more than one (1) site and one (1) computer will be using it at the same time. You must pay for additional copies of the software if more than one (1) site and one (1) computer are using the software at the same time.

C. You may not make any changes or modifications to the licensed software, and you may not disassemble, decompile or otherwise reverse engineer the licensed software. You may not rent or lease the licensed software to others. You may not use it on a computer network unless you have paid for a license for each user on the network at any one time.

D. You may distribute files that you develop with this software. It is important to note that the right to distribute the created files cannot be granted by you to another entity (a person or corporation). For example, if you use this program to create a Utility package that is intended for use by other software developers, you may distribute the created file with that package. But the entities to which you license your package are not authorized to distribute those same files with their products.

LIMITED WARRANTY

The owner warrants that the physical disks (if any) and physical documentation (if any) are free of defects in workmanship and materials for a period of thirty (30) days from the date of purchase. If the disks or documentation are found to be defective within the warranty period, the Owner will replace the defective items at no cost to you. The entire liability of this warranty is limited to replacement and shall not, under any circumstances, encompass any other damages.

THE OWNER SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

GOVERNING LAW

This license and limited warranty shall be construed, interpreted, and governed by the laws of the State of Delaware, in the United States of America, and any action hereunder shall be brought only in Delaware. If any provision is found invalid or unenforceable, the balance of this license and limited warranty shall remain valid and enforceable. Use, duplication, or disclosure by the U.S. Government of the computer software and documentation in this product shall be subject to the restricted rights under DFARS 52.227-7013 applicable to commercial computer software. All rights not specifically granted herein are reserved by the Owner.
