SOFTWARE LICENSE AGREEMENT

Andrew Weiser (the AUTHOR) provides this program (the SOFTWARE) and licenses its use under the terms and conditions stated herein. You assume responsibility for the selection of the SOFTWARE to achieve your intended results, and for the installation, use and results obtained from the SOFTWARE.

CONDITIONS - TRIAL VERSION

The trial version of the SOFTWARE is identified by the presence of the text "TRIAL" in the SOFTWARE version information displayed in the screen saver`s configuration window.

You may reproduce and distribute an unlimited number of copies of the trial version of this SOFTWARE; provided that each copy shall be a true and complete copy, including all copyright and trademark notices, and shall be accompanied by a copy of this license agreement.

CONDITIONS - REGISTERED VERSION

The registered version of the SOFTWARE is identified by the absence of the text "TRIAL" in the SOFTWARE version information displayed in the screen saver`s configuration window.

You are granted the right to copy the SOFTWARE onto a single computer and the right for you and others to use that copy of the SOFTWARE on that single computer. You may copy the software onto multiple computers (office, home, lap-top) provided that only one copy of the SOFTWARE is used at any time and such use is by you. You may copy the SOFTWARE onto a storage medium such as floppy disk or CD-ROM for backup or archival purposes.

Where the SOFTWARE is copied onto multiple computers, or is used on a network or file server, you must purchase a number of copies of the SOFTWARE equal to the number of users who will use the SOFTWARE.

In the event of you receiving a refund of the purchase price of the SOFTWARE, you must destroy all copies of the SOFTWARE and all of its component parts.

CONDITIONS - ALL VERSIONS

You may not reverse engineer, decompile, or disassemble the SOFTWARE, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

DISCLAIMER

THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS. THE AUTHOR HEREBY DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED. THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE. NEITHER THE AUTHOR NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES DUE TO LOSS OF DATA OR ANY OTHER REASON, EVEN IF THE AUTHOR OR AN AGENT OF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AUTHOR`S LIABILITY FOR ANY DAMAGES EVER EXCEED THE PRICE PAID FOR THE LICENSE TO USE THE SOFTWARE, REGARDLESS OF THE FORM OF THE CLAIM.

Some states do not allow the exclusion of the limit of liability for consequential damages, so the above limitation may not apply to you.
