License Agreement

Your use of this software indicates your acceptance of this license agreement and warranty.

1. Copyright

The Picture2avi Pro Software, including but not limited to the code, any associated files and documentations ("Software"), is owned by Sarah Small and is protected by copyright laws.

2. Shareware License

The Shareware License grants Licensee the non-exclusive and non-transferable right to install and use the Software. You are hereby licensed to use this software for evaluation purposes without charge for a period of 30 days. If you use this software after the 30 day evaluation period a registration fee is required for each and every computer that will run Picture2avi Pro.
The Licensee may not reverse engineer, disassemble, decompile, alter, or translate the Software, or otherwise attempt to derive the source code of the Software.

3. Distribution

Provided that you verify that you are distributing the evaluation Version, you are hereby licensed to make as many copies of the Shareware version of this software and documentation as you wish; give exact copies of the original Shareware version to anyone; and distribute the Shareware version in its unmodified form via electronic means. There is no charge for any of the above.

4. Insertion of Markers

Some features available in the Software may be used only in evaluation mode. Using of those features may cause insertion of some markers into output files to identify that the files are generated in the evaluation mode.
The full commercial license will allow using the Software free of such limitations.

5. Commercial Single User License

The Single User License grants Licensee the non-exclusive and non-transferable right to install and use the Software. The Licensee may make a copy of the Software for archival purposes. Any copies of the Software shall be complete copies including any copyright notices.
The Licensee may not reverse engineer, disassemble, decompile, alter, or translate the Software, or otherwise attempt to derive the source code of the Software.
The Licensee may not rent, lease, sell, sublicense, redistribute, lend or otherwise transfer the Software or any portion thereof if not expressly allowed in the stipulations of this Agreement.
The Licensee may not rent, lease, sell, sublicense, redistribute, lend or otherwise transfer the Software or any portion thereof if not expressly allowed in the stipulations of this Agreement.
The Licensee may use the Software on either stand-alone computers or on computer networks by a number of simultaneous users equal to or less than the number of Single User Licenses licensed by the Licensee.

6. Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE AVAILABLE "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY THER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which Picture2avi Pro may be put, there is NO WARRANTY OF OPERATION OR GUARANTEE THAT Picture2avi Pro will work in all environments.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR POSSIBLE REFUND OF PURCHASE PRICE.
To the maximum extent permitted by applicable law, in no event shall Sarah Small be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use this Software product, even if Sarah Small has been advised of the possibility of such damages.

7. Termination
If the Licensee fails to comply with any term of this Agreement, this Agreement is terminated and the Licensee has no further right to use the Software.
On termination, the Licensee shall have no claim on or arising from the Software. The Software and any copies shall be destroyed.
The Software is not available to those not permitted by laws to have access to the Software.

8. Delivery

The Software is obtained via Internet download.

9. Entire Agreement

This Agreement constitutes the entire agreement between the Licensee and Sarah Small. It replaces all other representations All modifications or extensions of this Agreement need to be put down in writing.

10. Construction clause

If for any reason a court of competent jurisdiction finds any provision of this Agreement, or portion thereof, to be unenforceable, that provision of the Agreement will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement will continue in full force and effect.

11. Legal Domicile and Applicable law

Legal domicile is Mannheim. This Agreement is made and shall be construed in accordance with the laws of Germany (excluding the U.N. Convention on Contracts for the International Sale of Goods).
